GENERAL RENTAL CONDITIONS

The service \"Rental of equipment\" is provided by Vilamoura Bikes, (hereinafter referred to as the lessor). The rental conditions are an integral part of the rental contract. By accepting the general terms and conditions, the hirer confirms that he/she has read and fully accepted the rental conditions.

1. Taking over the equipment

The hirer takes over the equipment in good working order. The hirer is obliged to make any complaints to the lessor at the time of taking over the equipment.

2. Return of the equipment

The hirer is obliged to return the equipment to the lessor at the end of the rental period defined in the rental agreement and during opening hours. The equipment and all accessories provided by the lessor (helmets, etc.) must be returned to the lessor in perfect condition. If the hirer has lost or damaged accessories, these will be charged to him/her. Material damage will be charged at the published rates.

3. Responsibility

The hirer is responsable for the bike, damage on the bike or third parties. In case of loss, damage or theft, the amounts to be charged are:
City bike: 500€ | Mountain bike 500€ | Eletric city bike Moustache 3.000€ | Eletric Bike Mate 3.000€ | Eletric Mountain Bike 2.000€ | Batery charger 80€ | Batery key 20€ | Helmet 20€ | Black front bag 15€ |Tube 10€ | Wheel spinning 25€ | Saddle or handles 25€. ALWAYS LOCK the bike with the padlock provided and at night keep the bike inside your home or hotel
4. Extension of the rental period

An extension of the rental agreement is only possible with the consent of the lessor before the end of the current rental agreement. The lessor may refuse such an extension without giving any reason.

5. Minimum age of the hirer

The hirer must be minimum age of 18 for the electric bikes.

6. Services and prices

The prices published by the lessor and in his brochures are valid.

7. Insurance

The hirer shall be responsible for insurance. By signing the rental agreement, the hirer confirms that he has adequately covered the risks associated with the use of the equipment. The equipment is not insured against theft and breakage. Our Insurance police conditions nº 1002883850 by Generali Tranquilidade are only for personal accidents during the bike rental period covering 3.500€ for medical treatments. Vilamoura Bikes represented by Jorge Manuel Contreiras Guerreiro Filipe Bartolomeu with a valid turistic license RNAAT nº 2139/2018. In case of accident with third partie our insurance doesnt cover damages in equipment of third partie or personal injuries. This is responsaibility of the hirer with agreedment beetween the hirer and third partie.
8. Helmets

An approved helmet is provided free of charge. Insurance will not be activated if helmets are not used during the rental.

9. Responsibility of the hirer

The hirer undertakes to use the rented equipment with care, without danger to third parties and in accordance with the attached safety instructions. The hirer is always responsible for the physical and material damages which he causes at the time of the use of the rented equipment (art.1023 of the civil code). Vilamoura Bikes will not engage its responsibility in case of damage or accidents undergone or caused by the hirer during the use of the rented equipment. The use in competition or for driving similar to a competition is forbidden. In the event of damage due to an accident, loss, theft or improper handling of the equipment, the hirer shall be liable for the costs of repair. In the event of total damage or loss, the hirer is liable for the replacement value of the equipment.

10. Flat tires policy
a) Mountain, City or Kids bike:
ON DELIVERY IN OUR SHOP: will be charged 20€ per each flat tire ; ASSISTANCE OUTSIDE OUR SHOP: assistence could take up to 2 hours until arriving on location of flat tire to solve the situation. The price with assistence is 30€ per flat tire.
WITHOUT ASSISTANCE: In case we couldn't assist you at the location, we suggest to put the bike without the front wheel on UBER XL or TAXI VAN and bring to our shop. The cost of transport will be deducted of the price of flat tire (20€) upon presentation of receipt.
FLAT TIRE REPAIR TOOL KIT: can be provided only one per rental and has to be requested by the client in the beginning of the rental. The repair kit must be returned in good conditions only without the air chamber used to solved the flat tire. In case the flat tire repair kit will not be returned, you will be charged with 30€. FLAT TIRE REPAIR TOOL KIT contains: airchamber, 3 plastic pieces and little air bomb.

b) Electric bikes:
ON DELIVERY IN OUR SHOP: will be charged 40€ per each flat tire ; ASSISTANCE OUTSIDE OUR SHOP: assistente could take up to 3 hours until arriving on location of flat tire to solve the situation. The price with assistence is 50€ per flat tire.

11. Security deposit

The lessor requires a credit card imprint, an identity document or a cheque as a deposit against loss, theft or damage to the equipment.

12. Applicable law

This contract is subject to Portuguese law. In the event of a dispute, in order to compare the points of view of the third parties and to enable them to find a solution to the dispute themselves, a mediator may be appointed by the parties or the judge beforehand. This mediation may then take two possible forms: conventional or judicial. In the event of mediation in the first instance and failure to resolve the dispute, the default court of jurisdiction would be that of the final lessee of the equipment. Upon agreement or in the event of different tenants and possible victims of damage, a single common court may be determined by the court.
